MetricBio, LLC (“MetricBio,” “we,” or “us”) values your privacy. This Privacy Notice describes our information practices and, in particular, explains how we use, collect and disclose your Personal Information, which we define below. This Privacy Notice applies to www.metricbio.org and any other website or mobile application that links to this Privacy Notice (collectively, the “Services”). By accessing or using the Services, you agree to the information practices described in this Privacy Notice.

DEFINITIONS
Below are the definitions of some terms we use throughout this Privacy Notice.

Personal Information” means any information that we directly associate with a specific person, or that reasonably can be used to identify a specific person. For example, this includes your name, home address, phone number, email address, and any other information that we tie to these elements. Personal Information includes the information that you provide when setting up an account on the Services, Research Question Information, and any other information that can be used to identify you.

Personal Information does not include “aggregated information,” which is information that we collect about a group or category of people. It also does not include “de-identified information,” which is information from which we or our agents have removed information that can be used to specifically identify a person. This Privacy Notice does not apply to our collection, use, or disclosure of aggregated or de-identified information.

Research Question Information” means, if you submit a Sample using the Services, the information, other than your Sample, that you disclose to us for us to use in our research, including your gender, height, weight, date of birth, and your responses to surveys containing research related questions.

Sample” means the biological sample you submit using a research kit as a part of your participating in our research.

Sample Information” is information regarding your Sample, generated through processing of your Sample by us or our agents.

 

SCOPE

This Privacy Notice applies to information collected through the Services, including Personal Information. If you choose to submit a Sample, this Privacy Notice does not apply to our treatment of your Sample, your Sample Information, or your Research Question Information after it has been collected through the Services. Your Sample, your Sample Information, and your Research Question Information, after it has been collected through the Services, will be treated in accordance with the consent form you sign at the time you enroll in the research study.

 

INFORMATION WE COLLECT AND USE

There are two categories of information that we collect through the Services.

1. Information you provide

We collect and store the Personal Information that you provide to us, for example, when you enter the information into form fields on our Services. In particular, we may collect:

  • Contact information, including your name, email address, physical address, and phone number, which we use to communicate with you, respond to your requests and inquiries, and send you Service-related communications, for example, account verification, changes or updates to features of the Services, and technical and security notices);
  • Registration information such as user ID, password, and date of birth, which we use to set up and maintain your account;
  • Online purchase information, including payment card information, purchase details, and other transaction information;
  • Communication preferences, which we use to manage how we engage with you;
  • Any communications between you and us, including the content of your voice and email messages, which we use to respond to your inquiries; and
  • Personal Information you choose include in your account or profile.

2. Information Collected Automatically

We use certain technologies on the Services to collect information that does not directly reveal your identity (“Other Information”). If we associate Other Information with Personal Information, we will treat the combined information as Personal Information in accordance with this Privacy Notice.

We use this Other Information to: (a) remember information so that you will not have to re-enter it next time you use the Services; (b) provide personalized content and information, including targeted content and advertising for other MetricBio products; (c) provide and monitor the effectiveness of our Services; (d) monitor aggregate metrics such as total number of visitors, traffic, usage, and demographic patterns on the Services; (e) diagnose or fix technology problems; and (f) otherwise to plan for and enhance the Services. The Other Information we collect may include the following:

  • Data Collected About Your Use of the Services: We may collect information about how you use the Services and about your actions on the Services, including your actions on the Services and interaction with dynamic features of the Services (“User Content”).
  • Logging Data: As is true of most websites, we gather information automatically and store it in log files. This information may include IP addresses, browser type, internet service provider, referring/exit pages, operation systems, date/time stamp, and/or clickstream data. We generally only use this data for purposes such as security, fraud detection and protecting our rights. When you access the Services with a mobile device, we may receive or collect and store a unique identification numbers associated with your device or our mobile application, mobile carrier, device type, model and manufacturer, mobile device operating system brand, and model.
  • Analytics: We use analytics providers to help us evaluate and measure the use and performance of the Services. One analytics provider we may use is Google Analytics. You may opt out of any aggregation and analysis of the data collected about you on the Services by Google Analytics, by visiting https://tools.google.com/dlpage/gaoptout and downloading and installing the Google Analytics Out-out Browser Add-on.   • Cookies and Data Collected Through Other Technologies: We and our service providers use cookies, web beacons and similar technologies to manage the Services and to collect information about you when you use the Services. In addition, we use local shared objects (or Flash cookies) to collect and store information about your preferences and interactions with the Services. These technologies help us to recognize you, enhance your navigation of the Services, analyze your use of the Services, and develop solutions for how to make the Services more useful. These technologies also allow us to enhance the usability of the Services by aggregating statistical data and compilations of information, which may or may not include Personal Information, and providing this information to our service providers.

 

ADDITIONAL USES OF PERSONAL INFORMATION

In addition to the uses described above, we may use Personal Information for the following purposes:

  • Developing new products and services;
  • Processing and completing your transactions, including, as applicable, confirming you order, processing payments, and delivering products and services;
  • Preventing, investigating, or providing notice of fraud, unlawful or criminal activity, or unauthorized access to or use of Personal Information, our Services or systems, or to meet legal obligations;
  • Enforcing our Terms of Service and any other agreements; and
  • For any other lawful, legitimate business purposes.

 

HOW WE SHARE AND DISCLOSE PERSONAL INFORMATION

We may share your Personal Information in the following ways.

Service Providers: With third party vendors, consultants and other service providers that perform services on our behalf, in order to carry out their work for us, which may include identifying and serving targeted content or service fulfillment, or providing analytics services. These providers include IT services and support providers, marketing and analytics providers, payment processors, and service providers who help us with responding to your requests. We typically require these service providers by contract to keep information confidential and to only use the information on our behalf and for the purposes of performing the work for which they have been hired.

Affiliates: With affiliated legal entities within our corporate structure, including our parent companies and subsidiaries for purposes and uses that are consistent with this Privacy Notice.

Legal Process, Safety and Enforcement of Terms of Service: With legal or governmental regulatory authorities in response to their requests for such information, to assist in investigations, or as otherwise required by law or regulation. For example, we may disclose your Personal Information to law enforcement authorities to help detect, prevent, or otherwise address criminal (including fraud or stalking), security or technical issues. We may also disclose your Personal Information to third parties in connection with claims, disputes, investigations, or litigation or when otherwise required by law, if we determine that its disclosure is necessary to protect the health and safety of you or us or to enforce our legal rights or any contractual commitments that you have made.

Business Transfers: As a part of a corporate transaction, such as a merger, financing or sale of all or a portion of our assets or shares, reorganization, change of control, joint venture, or acquisition of all or a portion of our business by another company or third party. Your Personal Information could be transferred to a third party as one of the business assets in such a transaction. It may also be disclosed in the event of bankruptcy, insolvency, receivership or related or similar proceedings.

As Authorized or Requested by You: With third parties at your request or with your permission in the following ways:

  • If you choose to share your Personal Information with your friends and family through the Services;
  • For research purposes, as specifically authorized by you in the consent form that you sign prior to entering into any research study or submitting a Sample;
  • To your authorized personal representative, such as a lawyer, administrator, executor, or other authorized person responsible you or your estate; and
  • For any other legally and ethically permitted reason that you request or authorize.

YOUR CHOICES REGARDING YOUR INFORMATION

Marketing Communications. If you do not wish to receive promotional emails, you can change your email preferences on your Settings page on our websites, or you can click the “unsubscribe” button on promotional email communications. Note that if you choose to unsubscribe from marketing communications, you will still receive messages from us regarding your account, such as account verification, change or updates to features of the Services, or technical and security notices.

Data Retention: We will retain your information for as long as your account is active or as reasonably useful for our commercial purposes, consistent with the terms of this Privacy Notice. You may deactivate your account at any time in your profile settings. You may contact us to request access, updates or deletions to your Personal Information at [email protected] if you wish to delete your account. If you have entered a research study and wish to withdraw from the research study, please follow the instructions for withdrawal outlined in the consent form that you signed at the time you entered the research study.

 

PERSONS UNDER THE AGE OF 13

The Services and its content are not directed at children under the age of 13 and we do not intend to or knowingly collect or solicit Personal Information online from children under the age of 13. We encourage parents and guardians to participate in and monitor their children’s online activity. If a child under 13 has provided Personal Information to us, we encourage the children’s parent or guardian to contact us at [email protected] to request that we remove the Personal Information from our systems. If you are under the age of 13, do not provide us with any Personal Information by any means.

 

LINKS TO THIRD PARTY WEBSITES OR APPLICATIONS

For your information and convenience, the Services may contain links to and from third party websites or mobile applications. We also process payments through the use of a third party service provider. This Privacy Notice does not apply to, and we are not responsible for, the practices of third parties that collect your Personal Information. Please check the individual policies before you submit any information to those websites.

 

UPDATES TO THIS POLICY

This Privacy Notice is subject to occasional revisions. If we make any changes to this Privacy Notice, we will change the Effective Date at the top of this Privacy Notice and will post the updated Privacy Notice on this page. If you object to any changes, you may discontinue your use of the Services. Continuing to use our Services after we publish changes to this Privacy Notice will indicate your acknowledgement of and agreement to be bound by the changes.
